CAN I CHANGE EMPLOYERS IF I HAVE AN I-485 PENDING ?

         Question:

Hi, I’m on L1A visa – executive/manager – approved until 2022. I have I-140 approved with priority date October 2019. Also filed I-485 in December, so it is now more than 180 days pending. I have been with same employer since 2013, same role/position etc. Now if I want to change employer –
Question 1) Can I do that with Supplement J?
Question 2) New employer cannot wait for that long, so should approval of Supplement J be taken first and then leave present job, or can I join the new company right away after Supplement J submission – given that the managerial position will be same in the new company.

If you are on an EB1C based I-140, you have had an adjustment pending for 180 days then you can move to another employer by filing a Supplement J. And the job duties should be similar and not very different from the present offer and duties.
