H-1B Transfer

Question: I am working for a company A full time and now I want to transfer my H-1B to Company B and start PERM process and join the company B later after 6 months.I have approved I-140 from company C. Does the above scenario works and if so, does my current company knows when I apply for H-1B transfer. I am in 6th year of my H-1B.

Answer: You can have multiple job offers from multiple employers. You will need the I-140 to be open and not withdrawn at the time you apply for the H-1B for Company B, and ask for 3 years of H-1B based on the I-140 approval. The current company is not informed of another company’s filing of H-1B transfer.
