HAVE APPROVED I-140, MY H-1B EXPIRES IN OCTOBER CAN I FILE EXTENSION NOW?

         Question:

I am currently on L-1A visa and recently got my I-140 (based on EB3) approved. My COS to H-1B was approved as well and will be effective from 1st October to 17th October (completing 6 years by then). My question is can I apply for H-1B extension now or can it be only applied after H-1B once the status becomes active?

Answer: 

It should be applied for after October 1st.
