HOW TO EXPEDITE GREEN CARD?

         Question:

I and my husband are both Indian citizens by birth and living in US on H-1B visa and have I-140 under EB2 filed with priority date June 2015. We plan to travel to Canada on a manager position and come back to US with the same company to manager position so we can file for EB1 category and expedite our Green card process. How soon should we travel back to US before our final action date becomes current to be able to file for H-1B visa again and be eligible to receive green card? Also since our I-140 is already approved we will not be subjected to Lottery process when we file for H-1B again, Is that correct?

Answer: 

       3 things:
       First, as soon as the dates are current you could file by coming into the country- have to enter on the H-1B though.

      Secondly, the EB1 C does take about a year or more to get approved.

      Third, you don’t have to go through the lottery if you have had an I 140 approved already.
