HOW TO GET OLD H1B EMPLOYER TO GIVE ME MY CASE?

Question:

Hi Pallavi,

Employer is holding H1B paperwork.
Out of project for 3 months due to COVID-19 situation, and currently employer is not able to find a job for me.

Found an opportunity but the new employer wants to transfer the H1B which is ok with me but current employer is not giving paperwork.

Please advice what can be done in such situation.

Answer:

You have to complain to the USCIS fraud line but warn this employer that you have consulted with an attorney and you would file a complaint through them. Secondly, if you have an alternate visa option- please re-enter the country with that status. Also, be aware that you can get some of your documents through a FOIA request.
