USCIS Reaches FY 2020 H-1B Regular Cap

USCIS has received a sufficient number of petitions to reach the mandated 65,000 H-1B visa regular cap for fiscal year 2020. USCIS will next determine if a sufficient number of petitions have been received to meet the 20,000 H-1B advanced degree exemption/master’s cap visa.

All unselected petitions will be returned with their filing fees.

USCIS will continue to accept and process petitions that are exempt from the cap, i.e. cap exempt petitions that are filed to:

• Extend the amount of time a current H-1B worker may remain in the United States;
• Change the terms of employment for current H-1B workers;
• Allow current H-1B workers to change employers; and
• Allow current H-1B workers to work concurrently in a second H-1B position.

H-1B applicants are encouraged to subscribe to the H-1B Cap Season email updates located on the H-1B Fiscal Year (FY) 2020 Cap Season page.
