Roll Back of October Visa Bulletin!

On September 25, 2015, the Department of State issued a revised Visa Bulletin for the month of October 2015, superseding the bulletin published on September 9, 2015. This radical change shattered dreams of thousands of potential applicants, who had gathered their documents, completed their medical examinations and incurred other costs based on the previous visa bulletin dates. To sight an example of such drastic change is EB2 for India, which moved from 7/1/2011 to 7/1/2009,… retrogressed by 2 years!

To refresh our readers, the new change introduced in the visa bulletin now provides filing dates for adjustment of status applications before the final action dates when the green card will actually be available.

We are thoroughly disappointed with the stance of the executive branch on this roll back of its previous announcements. We feel badly about the inability of the U.S. Court in Western District of Washington at Seattle to hold the Department of State to its prior announcement. We hope for successful legislative fix (H.R.213). We hope for well thought out executive actions, which are preceded by proper notice of public rule- making, as established by the Administrative Procedure Act. We hope that pending immigrants get through the green card process fairly quickly. We hope…..Oh well!!!!!:)
