WANT TO FILE GREEN CARD FOR MOM AS SOON AS SHE COMES TO STATES

         Question:

Hi Pallavi, My mother has a B1 Visa to the US and will be traveling here in February. I am a US Citizen and want to sponsor her Green Card as soon as she arrives here. I want to understand what documents will she need for both the I-130 and I-485 applications. Will she need her birth certificate? I have my birth certificate in which her name is mentioned, will that suffice? Her passport has her full name; whereas my birth certificate only says mother’s name. Will I need to do something to address this discrepancy? Also, while her Green Card is in process, can she travel back and forth to India. I live in Tennessee, does it make sense to consult with you even though my jurisdiction is Atlanta? Or are there any local lawyers you can recommend for me through your vast network? Thank you so much.

Answer:

Your mother is unable to file for a green card as soon as she enters as that interferes with her visitor intent and gets in trouble for immigration fraud. She is allowed to change her mind after 90 days of her entry. For a list of documents- birth certificates for her and you and asset evaluations for her are required. I wouldn’t allow her to carry any of those on her person.
