On September 19, 2025, the U.S. Department of Labor (DOL) announced the launch of Project Firewall, a significant H-1B enforcement initiative aimed at strengthening protections for American workers while holding employers accountable for compliance.

What is Project Firewall?

Project Firewall is designed to ensure that the H-1B program serves its intended purpose: to supplement, not replace, the U.S. workforce with highly skilled foreign talent. The initiative directs federal agencies to investigate employers suspected of abusing the H-1B visa system. For the first time in the agency’s history, the Secretary of Labor will personally certify the initiation of certain investigations when there is reasonable cause to believe that violations exist.

Enforcement Measures and Consequences

Employers found in violation of H-1B program rules could face:

  • Payment of back wages to affected workers
  • Civil monetary penalties
  • Temporary or permanent debarment from the H-1B program

The DOL will also coordinate with the Department of Justice, Equal Employment Opportunity Commission, and U.S. Citizenship and Immigration Services to maximize oversight and enforcement.
