On August 5, 2026, U.S. Citizenship and Immigration Services issued Policy Alert PA-2026-05, updating Volume 1 of the USCIS Policy Manual on evidence, Requests for Evidence (RFEs), and Notices of Intent to Deny (NOIDs). Much of the attention has focused on denials without an RFE. Equally important for anyone who does receive a notice is how the RFE response deadline now works.
Twelve Weeks Is a Ceiling, Not a Standard
Under 8 CFR 103.2(b)(8)(iv), an RFE response period may not exceed twelve weeks, and a NOID response period may not exceed thirty days. Previous USCIS policy generally gave the full twelve weeks. USCIS now states that officers are not required to provide that standard period. Your notice may allow less time, and no extension is available.
Overseas Filers Lose the Extra 14 Days
USCIS previously added 14 days when a notice was mailed outside the United States. That practice has ended. Regardless of location, only the 3 days permitted under 8 CFR 103.8(b) for mailed notices now apply. Petitioners and beneficiaries living abroad, including foreign investors and consular processing cases, should act the moment a notice arrives.
A Partial Response Is Treated as Final
USCIS now considers any evidence submitted in reply to an RFE or NOID, even a partial reply, as a request for a decision. There is no opportunity to send the remaining documents later. Every item requested should be addressed in a single, complete package. If a document cannot be obtained in time, explain why within the response and include the best available alternative evidence.
Evidence Weight Matters More
The updated guidance clarifies the difference between initial and additional evidence, primary and secondary evidence, and the weight given to affidavits submitted in place of primary or secondary evidence. Where an official record exists, provide it, or document why it is unavailable before relying on sworn statements.
