Question:
I was on L1A (valid till 2023) and my I-140 got approved in July of 2020 with a priority date of October 2019. However, since no projects etc. due to COVID-19 I have moved to India and resigned from the company who did the I-140 processing.
As per current visa bulletin, it is current through September 01, 2020 for EB1 category. So, can you please confirm if I can apply even though I am not with the company. If so, does your firm help with consular processing from India?
Answer:
Consular process is not automatic. You will have to first file an I-824 for getting the consular paperwork started. The company still has to authenticate the open job offer and if they don’t, then the process cannot go on.
