What is the E-2 Treaty Investor Visa?
The E-2 is a U.S. nonimmigrant visa for nationals of qualifying treaty countries who invest a substantial amount of capital in a U.S. business It allows the investor (and certain employees) to live in the U.S. while directing that enterprise.
Who qualifies for an E-2 Visa?
ou must be a citizen of a country with a U.S. investment treaty (e.g. Japan, Germany, Canada, the UK. You must have already invested (or be actively investing) significant funds in a real U.S. enterprise, and you must intend to develop and run the business (usually by owning at least 50% and serving in a managerial role)
How much money is “substantial”?
There is no fixed minimum, but investment must be proportional to the business. USCIS says it should be enough to make success likely. Generally about $100,000-$700,000 or more is treated as substantial, but a smaller amount can qualify if the business is low-cost
What businesses qualify?
The business must be a bona fide for-profit enterprise that is more than marginal This includes things like tech startups, restaurants, consulting firms, franchises, etc. Passive investments (like rental properties or stock portfolios) do not qualify
Can my family come too?
Yes. Your spouse and unmarried children under 21 can accompany or join you as dependents. Spouses are automatically eligible to work in the U.S., and children can go to school.
Does E-2 lead to a Green Card?
No. The E-2 is a nonimmigrant visa (you must intend to return home eventually). It does not directly provide permanent residency. If you want a green card later, we can advise you on other visa paths when the time comes
