HAD OPT WITH BLACKLISTED EMPLOYER, WILL THIS AFFECT MY H-1B CAP PETITION?

Question:

Hello Pallavi,

During my initial OPT (2017 July to 2018 May), I got offer letter from Wireclass company(which is currently blacklisted by USICS). I left Wireclass, once I came to know that they were issuing offer letters to many candidates. I believe , this is going to affect me, when it comes to application with USCIS (like H-1B). My H1-B got picked recently, is it ok to proceed with H-1B application or do I have any other option.

Thank You

Attorney Mrs. Pallavi Ahluwalia’s response:

This will cause an issue for you, for sure. Because you remained ‘working’ for a fraudulent employer for 10 months way past your allowance. And yes it will eventually get denied.  No other options unfortunately.
