SCHEDULED BIO-METRIC APPOINTMENT BUT LEAVING THE COUNTRY

Question:

My dad is here on a tourist visa. His six months stay was granted until March 19, 2020. Because of the COVID-19 pandemic and him being 66 years old, we filed for a extension on March 16, 2020 to stay. Hoping the situation might of improved; we got the receipt notice but did not see any changes in his case status until September 18, 2020. IN the meantime we booked a ticket for him on August 26, 2020, but Nepal cancelled the air travel. It was rescheduled for September 26, 2020. Now on September 18, 2020, his online case status shows he is scheduled for bio-metrics. Since he is leaving this Saturday, how do we take care of this? We do not have the official letter yet on hand to go and have this done. Major concern is he has to reapply for his tourist visa back home or for Green Card. Will this affect him in the near future?

Answer: 

He must leave before the end date which he requested for in his extension and since he hadn’t, he may have an issue with overstaying a bit. For the bio-metric appointment, you have to write to USCIS and let them know that your parent is leaving the country and will not be available and that the 180 day period is over.
