Applying for Parents Who Have Been Denied Asylum

Question:

Hello, my mother in and father-in-law apply asylum 2010 it was denied and we apply higher court 2014. It was denied and removal process they voluntarily went back to the country. My husband apply for his citizenship hopefully by this year or early next year will have interview. Last month my father-in-law passed away but they have bar for 10 years since 2014 so how can we waived that bar for my mother in law or we have to wait complete 10 years to apply for green card after his son became citizens.

Answer:

The law is not set up for waivers for parent, specially here in this case, parents of adult children. Most likely , she will have to let her 10 years pass and be eligible in 2024. Please make sure that the filing of the petition for her is done in a timely fashion and that the interview at the consulate happens after the 10 year bar is run out.
