EB2 TO EB3 DOWNGRADING

Dear Pallavi,

My Green Card is filed in EB2 with priority date of January 2013, with recent movements in EB3, does it make sense to downgrade to EB3? What is the downside? If EB2 moves faster for “Final Action”, will i be bale to use my EB2 application for Final action?

Answer: 

For the downgrade to work, the labor should be written to qualify for EB3- so with experience of over 2 years or a 4 year bachelors degree. You can downgrade. And yes when the dates move you can try and attach the approved EB2 to the upgrading the pending adjustment. This process is not very dependable and has a lot of hassles but can be tried.
