Question:My spouse is on an H4 arrived to U.S on Friday April 1st, her H4 stamped was valid till 04/04/2022, she got her I-94 only until 04/04. Since it was weekend she arrived with my 2 kids, I hurriedly created 3 email accounts and filed for online extension and got a receipt number, I also sent paper extension to Dallas locker facility.
I am worried about her legal status in U.S. will she and my kids have any issues? Will her extension request be accepted? what happens to the online application and the paper application that I sent will they reject all because they are duplicates?Answer:Attorney Mrs. Pallavi Ahluwalia’s response: Cannot do two filings. Only one which must be sent out or submitted prior to the I-94 running out. Why did she not show the H1B approval notice for you the spouse? It would be better to send out for stamping once the USCIS lets you know whether they are approving or denying the case and you wouldn’t know this till you receive an approval or denial.
