ON H1B BUT CLIENT CHANGED DO I NEED A NEW LCA OR DO I AMEND MY H1B

Question:

I have an approved H-1B extension till Sep 2023 with my employer and I happened to change my client, which is within A 40 miles radius from the old client location. I am planning to go to India and I am eligible for the Dropbox process, so my question is do I have to file an LCA or Amended or nothing is needed? As the client locations are within 40 mile radius? Will that be a possibility for the Visa interviewer to call in for an interview? If it called for an interview does the VO provide appointment or do I have to wait till the consulate opens in India and book a slot?

Answer:

It has to be amended based on Matter of Simieo, if the change takes you away from the MSA. Kindly that is an analysis which you require you to either engage our firm or revert back to your company’s attorneys for advice. All the best
